Welcome to Canarie. By accessing our website, you agree to be bound by these Terms of Service. By using our services, you represent that you are at least the age of majority in your jurisdiction (e.g., 20 years old in Thailand), or that you have obtained verifiable parental or guardian consent to use this platform.

1. Disclaimer of Warranties

YOU UNDERSTAND AND AGREE THAT THIS SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND. CMKL UNIVERSITY MAKES NO REPRESENTATIONS AND DISCLAIMS ANY WARRANTIES OR CONDITIONS OF SATISFACTORY QUALITY, MERCHANTABILITY, OR NON-INFRINGEMENT. CMKL UNIVERSITY MAKES NO WARRANTIES THAT THIS SERVICE IS FREE OF MALWARE OR OTHER HARMFUL COMPONENTS. IN ADDITION, CMKL UNIVERSITY MAKES NO REPRESENTATION NOR DOES IT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY THIRD-PARTY APPLICATIONS (OR THE CONTENT THEREOF) OR DEVICES.

NO ADVICE OR INFORMATION WHETHER ORAL OR IN WRITING OBTAINED BY YOU FROM CMKL UNIVERSITY SHALL CREATE ANY WARRANTY ON BEHALF OF CMKL UNIVERSITY.

2. Data Loss and Backup

You acknowledge that while using this service there might be an unexpected incident or error that might, as a result, damage or cause loss of your data. You must create a backup of your data or any information uploaded to the infrastructure at all times. In case of any damage or loss of your data, CMKL University's liability shall be limited to the maximum extent permitted by applicable law.

Please be aware that occasional data loss may occur during ongoing configuration or maintenance processes.

3. Account Security

You are responsible for securing your access, username, and password, and shall not share them with any third parties without prior consent from CMKL University. In the event of any data breaches, CMKL University implements commercially reasonable security measures as required by applicable laws, but our liability for damages occurring from such breaches is limited to the maximum extent permitted by applicable law.

4. Trial Phase Data Erasure

You acknowledge that after the trial phase ends, your account information and all of your data on the infrastructure WILL BE ERASED from the system. We advise you to constantly backup or download all of your data.

5. Prohibited Data

The following type of data or information is prohibited and not allowed to be uploaded into the system:

  • 5.1 Personal data or any data that might be used to identify individuals, except for data explicitly required by us for account creation, billing, or platform operation.
  • 5.2 Illegal data including but not limited to intellectual property infringement data, sensitive data, violent data, or data that might affect national security.

CMKL University has the right to delete any prohibited data uploaded into the system without prior notice. CMKL University reserves the right to seek compensation for damages caused by your uploading of prohibited data. You agree to be solely responsible for all the information or data uploaded into the system by you.

6. Data Security and Storage

All collected personal data is stored securely and is accessible only by authorized members of the Canarie team ("Team Canarie"). We implement appropriate technical and organizational measures to:

  • Prevent unauthorized access, use, or disclosure
  • Ensure the integrity and confidentiality of personal data
  • Maintain system availability and reliability

We conduct internal reviews and security audits periodically to ensure data protection standards are upheld.

7. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold CMKL University harmless from and against damages, losses, and expenses arising out of or related to your breach of these Terms of Service.

8. Refunds and Cancellations

All purchases and subscriptions made on Canarie are final and non-refundable unless otherwise required by consumer protection laws. You may cancel your subscription at any time, but no refunds will be issued for partial billing periods.
